Celsius Holdings, Inc., a popular energy drink company, recently reached a settlement in a class-action lawsuit that could potentially award customers up to $250 each. The lawsuit claimed that the company labeled its products as “containing no preservatives” even though they contain citric acid, which the company argued is used as a flavor. Despite denying the allegations, the company agreed to the settlement.
Under the settlement, those who purchased Celsius drinks or powders between January 1, 2015 and November 23, 2022 could be eligible for money, but only if they live in the US and bought the products for personal or household use and not for resale or distribution.
The maximum payment per household with a valid receipt is $250, while those without receipts can receive up to $20. Customers who submit a valid claim form can receive $1 for each product purchased during the eligible time frame and $5 for multipacks of 14 Celsius On-The-Go or Flo Fusion powdered drinks.
All varieties of Celsius drinks, including Celsius Heat, Celsius BCAA+Energy, and Celsius with Stevia, as well as Celsius On-The-Go and Flo Fusion powdered drinks, are eligible for the settlement.
The deadline to submit a claim is February 13, 2023. Other options include excluding oneself from the settlement, objecting to the settlement, or attending a final fairness hearing on March 31, 2023 (if not excluding oneself from the settlement).
This settlement follows the news that Celsius was ordered to pay rapper Flo Rida $82 million after a jury found the company guilty of breaching an endorsement deal from 2014 to 2018 and hiding information from Flo Rida.
